Wabora owner granted access to restaurant despite probation

A local restaurateur will be allowed access to his Bracebridge establishment despite having been banned since January of 2021.

Min-Soo Kim, 50, of Gravenhurst was in a Bracebridge courtroom earlier this week to petition Justice Cecile Applegate for access to Wabora Japanese fusion restaurant on Wellington Street.

On May 25, 2021, Kim was sentenced following a conviction for sexual assault stemming from an incident that occurred at Wabora on Jan. 17, 2019. He was sentenced to 12 months in custody followed by a term of probation. As part of that probation, Kim was not allowed to be inside Wabora as the victim works in close proximity to the restaurant. 

The defence argued that Kim’s prolonged absence has resulted in serious negative consequences for the business. 

The Crown argued that allowing Kim access could be potentially harmful to the victim, as she works in close proximity to Wabora.

Justice Applegate agreed that the crime was a “serious sexual assault” but balanced that against the potential demise of the restaurant and the effects it would have on those working there.

She allowed a variation for Kim to attend the restaurant, but under a number of conditions as to when and how he could attend.
