A Bracebridge man found himself sentenced to jail and banned from owning firearms for life after pleading guilty to multiple charges in a Muskoka courtroom recently.
Last month, Mathew Foley, 33, pleaded guilty to impaired driving, refusing a demand for a breath sample, driving while prohibited, uttering threats, unlawful possession of a firearm and possession of fentanyl.
The court heard that on February 12, 2022 the Bracebridge OPP received a call for service regarding a man who had been using fentanyl and was now smashing items inside a house. Before the police arrived the suspect had left the scene in a pickup truck, despite the fact that his license was suspended for impaired driving at the time.
A short time later the police found the vehicle stuck in a snowbank and Foley passed out in the driver’s seat. They also found drug paraphernalia in the car and fentanyl in Foley’s coat. Upon being awakened Foley declined to give a breath sample and the police also determined that he was on probation. Police also found a number of improperly stored firearms at Foley’s residence.
Foley was sentenced to 90 days jail to be served intermittently, probation, a two-year driving ban and he was prohibited from owning firearms for life.
“It’s not a pretty picture to conjure up of you at the side of the road passed out with fentanyl in your lap,” said Justice Edward Carlton in passing sentence.
