Bracebridge man’s “Kinder Surprise” revealed to be cocaine

A Bracebridge man will be spending time behind bars after he pled guilty recently to several crimes including assaulting a police officer, breaking multiple court orders and possession of cocaine for the purpose of trafficking.

Kenneth Lubinsky, 32, was in a Bracebridge courtroom recently to plead guilty to multiple incidents that have occurred over the past year.

Court heard that on December 20, 2022 Bracebridge OPP were on patrol when they spotted Lubinsky at approximately 1:50 p.m. The police were aware Lubinsky had a warrant out for his arrest after missing several court appearances. 

When the officers attempted to speak with Lubinsky, a dog with him became aggressive towards the officers, court heard. Lubinsky refused to give the dog to his nearby partner and warned the officers that the dog would bite them. As two officers attempted to make the arrest, the dog bit both of them and Lubinsky, before Lubinsky was ultimately arrested. 

On June 30 2023 the Bracebridge OPP observed Lubinsky, who was again wanted for violating court terms, leaving a local motel, and caught up with him at a nearby laundromat. The OPP attempted to make an arrest but Lubinsky fled out the back door of the laundromat. 

The police eventually caught up with Lubinsky who resisted arrest and continued his efforts to flee police before ultimately being arrested. Police found two bags of cocaine on Lubinsky, one containing 20.4 g and the other containing 2.8 g, as well as cash and a spring-assisted knife. They also found 5.5 g of cocaine stashed inside a Kinder Surprise egg. 

Lipinski was ultimately sentenced to 265 days in jail, a $2,000 fine, a one-month driving ban and 15 months probation.

    Why are judges so reluctant to give sentences that will actually deter Felons ? This is well. On his way as a career criminal and obviously has no respect for the law or the punishments sparingly dished out to him!
