A Gravenhurst man was in court recently to plead guilty to his sixth conviction for impaired driving and his third conviction for failing to provide a breath sample.
Appearing recently in a Bracebridge courtroom, Russell Stubbs pled guilty to impaired driving and failing to comply with a demand for a breath sample.
Court heard that on May 26, 2023, at 12:22 am a member of the Bracebridge OPP observed a vehicle on Hwy 11 South in Gravenhurst travelling at an “extremely slow rate of speed.” The car swerved while exiting the highway at Doe Lake Road and failed to pull over when the officer activated his lights, court heard. The officer ultimately pulled alongside the vehicle being driven by Stubbs and he pulled over.
Stubbs admitted to having consumed alcohol but refused to provide a breath sample.
The court heard of Stubbs’s many previous convictions for impaired driving-related offences.
The Crown argued for a sentence of nine months in jail but the defence said that length of incarceration was “totally out of line.” He argued that it’s been more than 20 years since Stubbs’s last conviction and he had simply “fallen off the wagon.”
Stubbs was ultimately sentenced to nine months in jail and a two-year driving ban.
